Regulation (EU) 2025/40 on Packaging and Packaging Waste

August 2026. The First Critical Milestone.

From 12 August 2026, the first binding PPWR requirements take effect — including documentation obligations, restrictions on substances of concern, and the EPR registration requirement in each Member State where packaging is placed on the market. Further requirements follow in stages through to 2040.

Key Requirements at a Glance

Substances in Packaging

Restriction of substances that negatively affect reuse and recycling — including REACH chemicals and PFAS bans for food-contact packaging.

Recyclable Packaging

All packaging must be designed to be recyclable. Packaging below recyclability performance grades 70% and 80% will be banned from 2030 and 2038 respectively.

Recycled Content in Plastic Packaging

Plastic packaging must contain a minimum share of recycled material — with graduated targets by packaging type from 2030 and 2040.

Reusable Packaging

Reusable packaging must meet minimum reuse targets and be integrated into an approved take-back and refill system.

Labelling

All packaging must carry harmonised labels — covering material composition, recyclability, and obligations under extended producer responsibility.

Packaging Minimisation

Packaging must be reduced to the necessary minimum. Packaging designs that artificially inflate the perceived volume of a package are prohibited.

Consequences of Non-Compliance

Product bans

Products with packaging that fails to meet PPWR requirements will be withdrawn from the EU market.

Financial Penalties

The PPWR obligates Member States to establish dissuasive sanctions for violations.

EPR Contributions

Packaging with lower recyclability will be subject to higher financial contributions under the applicable extended producer responsibility schemes.

Key Requirements on the PPWR Timeline

The PPWR fundamentally reshapes packaging requirements and takes effect in multiple stages — confronting companies with new obligations over a period of years. The effective date of individual requirements may shift where these are contingent on the entry into force of subsequent implementing or delegated acts.

August 2026

First requirements take effect: bans on certain substances and documentation obligations for all packaging placed on the market from this date. Companies must register in each Member State where they place packaging on the market for the first time.

Februar 2027

Member States enact national penalty frameworks for violations of the PPWR. Producers may for the first time identify their packaging with an EPR label via QR code.

Packaging must for the first time carry harmonised labelling, and empty space in sales packaging must be restricted to the required minimum.

Januar 2030

The core PPWR requirements take effect: all packaging must be recyclable, plastic packaging must contain a minimum share of recycled material, and packaging must be reduced to the necessary minimum.

Januar 2035

Recyclability becomes a second weighting factor: packaging must not only be designed to be recyclable, but must demonstrably be recycled at scale.

Januar 2038

Only packaging achieving recyclability performance grades A or B may be placed on the market. Packaging with a recyclability rate below 80% is prohibited.

Januar 2040

Significantly increased mandatory recycled content targets apply to all plastic packaging, along with stricter reuse targets for specific packaging categories.
